Welcome to Only Canada. These Terms of Service ("Terms") govern your use of our website and your purchase of products from our store. By accessing our site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our site.

1. About us

Only Canada is an online store offering Canada-themed apparel and accessories produced on a print-on-demand basis. In these Terms, "we", "us", and "our" refer to Only Canada, and "you" and "your" refer to you, the site visitor or customer.

2. Eligibility

You must be at least the age of majority in your province or territory of residence (18 or 19 in Canada, depending on location) to place an order. By placing an order, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Products and availability

Our products are made to order through our print-on-demand partners. This means:

  • Each item is produced specifically for you after you place your order
  • Production and delivery take longer than from a traditional retailer
  • Minor variations in print placement, colour, and fabric are normal and expected
  • Stock can change without notice, and we reserve the right to discontinue any product at any time

We make reasonable efforts to display products and colours accurately, but we cannot guarantee that your device's display matches the real item exactly.

4. Pricing and currency

All prices are listed in the currency shown at checkout and are subject to change without notice. Prices do not include applicable taxes or shipping fees, which are calculated and displayed at checkout. We reserve the right to correct pricing errors, even after an order has been placed, and to cancel any affected order with a full refund.

5. Orders and payment

When you place an order, you are making an offer to purchase. Your order is accepted only when we send you an order confirmation email. We reserve the right to refuse, limit, or cancel any order at our discretion, including orders that appear fraudulent or that violate these Terms.

Payment is processed securely through Stripe. By submitting an order, you authorize us and Stripe to charge your chosen payment method for the full order total.

6. Shipping and delivery

We ship to the destinations listed at checkout. Shipping times and costs depend on your location and the fulfillment location of your item. Because items are produced on demand, total delivery time includes both production and shipping time.

We are not responsible for delays caused by shipping carriers, customs processing, incorrect addresses provided at checkout, or events outside our reasonable control. Risk of loss and title pass to you when the carrier takes possession of the item.

International customers are responsible for any import duties, customs fees, or taxes imposed by their destination country.

7. Returns and refunds

Because our products are made to order, we offer refunds or replacements only in limited circumstances, such as manufacturing defects, damage in transit, or order errors. You must contact us within 30 days of delivery to report any issue. Full details are available in our Returns Policy.

8. Accounts and login

Some features (such as order history) require you to sign in using an email magic link. You are responsible for keeping access to your email account secure. You must notify us immediately if you suspect unauthorized access to your account.

9. Acceptable use

When using our site, you agree not to:

  • Use the site for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any part of our systems
  • Interfere with or disrupt the site or its underlying infrastructure
  • Use bots, scrapers, or automated tools to collect information from the site
  • Submit false, misleading, or abusive reviews or contact messages
  • Impersonate any person or misrepresent your affiliation with any person or entity

10. Intellectual property

All content on this site — including text, graphics, logos, product designs, photos, and the Only Canada name and brand — is owned by Only Canada or its licensors and is protected by Canadian and international copyright and trademark laws. You may not copy, reproduce, modify, distribute, or create derivative works from our content without our prior written permission.

11. User-submitted content

When you submit a product review or other content to our site, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and moderate that content in connection with our store. You represent that your submission is your own, is accurate, and does not violate any third-party rights. We reserve the right to remove any submission at our discretion.

12. Disclaimer of warranties

Our site and products are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms limits or excludes any rights you have under the consumer protection laws of your province or territory that cannot be limited or excluded by contract.

13. Limitation of liability

To the maximum extent permitted by law, Only Canada and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of our site or products. Our total liability for any claim related to an order is limited to the amount you paid for that order.

14. Indemnification

You agree to indemnify and hold Only Canada harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the site, or your violation of any law or third-party right.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that province, without regard to conflict of laws principles. You agree that any dispute arising from these Terms or your use of our store will be brought exclusively in the courts located in Ontario, Canada, except where prohibited by the consumer protection laws of your home province or territory.
